Behavioral Support Strategies

Restricted measures like time-outs, manual restraints and mechanical restraints, or temporarily restricting certain rights can be used, but only when certain criteria are met, including 

  • a documented risk of harm or risk of legal sanction,

  • there is a record of positive strategies that have been tried and have failed,

  • the person or their guardian have given informed consent, and

  • approval has been granted by a human rights committee

 

Considering Restrictive Measures

A restrictive measure may allowed when there is a documented risk of harm or legal sanction.

  • Risk of harm includes a direct and serious risk of physical harm to the person or to someone else. The person must be causing or very likely to begin causing physical harm. They must also be capable of causing physical harm. 

  • Risk of legal sanction includes the risk of eviction, arrest, or incarceration.

 

Before Implementing a Restrictive Measure

Before implementing a restrictive measure the team should ensure that 

  • there is a single person-centered plan, meaning the person's individual service plan includes behavioral support, strategies with no separate behavioral support plan,

  • the proposed restrictive measure is the least restrictive option,

  • they have obtained informed consent to use an agreed upon restrictive measure from the person or their guardian,

  • the team has obtained the approval of the Human Rights Committee,

  • the team has notified the DODD using the Restrictive Measure Notification process,

  • providers have been trained on using the restrictive measure, and 

  • any other restrictive measure requirements have been met. 

90 day reviews

  • Has the team reviewed documentation for the effectiveness of strategies (is electronic or telecommunication acceptable)
  • Has the team determined if the strategies should be continued, discontinued, or revised?

  • If the restrictive measure is continued, has the team made the decision based on up-to-date information indicating the risk of harm or likelihood of legal sanction is still present?

  • Did the team include the person with disabilities (unless they chose otherwise)?
