Background Checks for Employment

DODD and all county boards of developmental disabilities are required to conduct background checks for applicants under final consideration for employment, those being transferred to the department or county board, or those being recalled or re-employed after a layoff.

Provider agencies are required to conduct background checks for applicants under final consideration for employment for a direct services position with the agency or any person employed in a direct services position by the agency.

A subcontractor in the case of an applicant under final consideration for a direct services position with the subcontractor or a person employed in a direct services position by the subcontractor.

Disqualifying Offenses

Convictions that disqualify an applicant for employment are listed in OAC 109.572.

Exclusionary Period 

A person who has committed a specified offense is disqualified from being employed for a period of time after the offense has been committed. After an exclusionary period is over for a person, a responsible entity is permitted to employ them. Multiple disqualifying offenses result in a longer exclusionary period.
