This memo provides clarification and guidance for county boards of developmental disabilities about how to ensure free choice of provider and proper billing for Remote Support.
When using paid backup support, the Free Choice of Provider process is administered when the person with disabilities selects the Homemaker/Personal Care (HPC) provider agency that will be providing the backup support. The selected HPC agency may choose to sub-contract with a vendor company of their choice. The sub-contracted company (the vendor) would provide the staff that would provide the Remote Support.
When using unpaid backup support, the Free Choice of Provider process is administered when the person with disabilities selects the vendor company that will provide the staff that would provide the Remote Support.
Backup support must be in place before Remote Support services can be billed through the waiver. Those supports may be paid (HPC agency) or unpaid (natural support).
Whether paid or unpaid, the person's individual service plan must specify the "reasonable amount of time" in which the backup support must respond, upon being contacted by the vendor.
When Using Paid Backup Support
A Homemaker/Personal Care provider agency is selected by the person or their guardian through the Free Choice of Provider process. The chosen HPC agency is listed on the payment authorization for waiver services (PAWS).
The HPC agency may choose to provide the staff who work remotely or to contract with a vendor of their choice that is certified by the Ohio Department of Developmental Disabilities to provide Remote Support.
The vendor is responsible for equipment maintenance, installation, and purchase. The vendor will bill the waiver for all Assistive Technology equipment.
The HPC agency bills for all hours of Remote Support provided and then pays the contracted vendor for the hours provided at the agreed upon rate.
If the vendor contacts the HPC agency to request in-person assistance, the paid backup support person's time shall be billed as Homemaker/Personal Care or Participant-Directed Homemaker/Personal Care, as applicable. The Remote Support vendor will end payment when the HPC staff is on site and may resume when the HPC staff leaves.
When Remote Support is provided to multiple people who live in the same residence, the payment rate for Remote Support shall be divided equally among the people concurrently receiving Remote Support.
When Using Unpaid Backup Support
The Remote Support vendor is selected directly by the person or their guardian through the Free Choice of Provider process. The Remote Support vendor is listed on the PAWS.
The vendor bills directly for all hours of Remote Support provided.
If the vendor contacts the unpaid backup support person to request in-person assistance, the vendor will end payment when the unpaid support person is on site and may resume when the unpaid support person leaves.
